By using any kazpa software, tools, content, or services, you acknowledge that trading and investing in financial markets involves substantial risk. You should only use our products if you fully understand these risks and are prepared to accept them. Do not use our software if you do not understand or cannot bear the potential financial loss involved.
kazpa licenses software that may be used for trading purposes. Trading forex, CFDs, commodities, indices, cryptocurrencies, and related assets involves significant risk and is not suitable for all individuals. Never trade with funds you cannot afford to lose. You should consult a licensed financial advisor, attorney, or tax professional before engaging in any trading or investment activity.
02Not financial, investment, or commodity trading advice
kazpa is not a broker, dealer, financial advisor, investment advisor, asset manager, or fiduciary. We do not manage client funds, execute trades, provide trade signals, or provide individualized investment advice. Our products, communications, documentation, and educational materials are provided for informational and educational purposes only.
kazpa is not registered with the CFTC or NFA as a Commodity Trading Advisor (CTA) or Commodity Pool Operator (CPO), and nothing we provide should be construed as commodity trading advice or a solicitation to trade. The software operates only on the user’s own account, on infrastructure the user controls, and runs only when the user chooses. If kazpa’s services ever change such that any of these statements would no longer be accurate — for example, an account-configuration or "done-for-you" operated service, a copy-trading feature, or a trade-signal service — kazpa will update this disclosure and obtain any registrations required before offering the service.

03Forecast and risk tool (educational only)
kazpa may provide a general market forecast (for example, a weekly outlook) and a dashboard risk tool that estimates risk based on your account size and lot settings. These are provided for general educational purposes only. They are not trading signals, recommendations, or individualized investment advice; they carry no guarantee; and the decision whether to run the software on any day, and at what lot size, rests entirely with you. Indicators such as "favorable conditions" describe general market conditions only and do not predict, promise, or recommend any outcome or action.
04User responsibility (risk, lot size & monitoring)
You are solely responsible for selecting your lot size, leverage, risk settings, and trading parameters based on your account size and personal risk tolerance. Incorrect lot sizing or excessive leverage can result in rapid losses or complete loss of funds.
You are responsible for monitoring your trading account while the software is running and for disabling trading if market conditions, account circumstances, or risk tolerance changes. You are also solely responsible for all tax reporting and payment arising from your trading; your broker provides statements, and kazpa issues no tax forms and has no reporting, withholding, or remittance duty.

kazpa does not represent or guarantee that any account will achieve profits or experience results similar to any sample data, backtests, or performance illustrations shown. Past performance does not guarantee future outcomes.

07Foreign exchange & leverage risk
Trading forex and CFDs often involves leverage and high volatility, which can amplify both gains and losses. You should carefully assess your objectives, experience, and financial condition before trading. kazpa does not provide execution services and does not control broker pricing, spreads, slippage, or liquidity. Some foreign brokers offer substantially higher leverage (for example, up to 500:1) than US brokers (typically capped at 50:1 for retail forex). Higher leverage magnifies losses as well as gains. You choose, verify, and fund your own broker, and you are solely responsible for your use of leverage and for any movement of funds to or from non-US or offshore brokers.
08Software & technology risk (AS IS)
Use of kazpa software may involve technical risks, including connectivity issues, latency, VPS outages, MetaTrader platform updates, system bugs, or data loss. The software is provided "as is" without warranties of any kind. kazpa is not liable for losses resulting from software errors, platform issues, hardware failure, connectivity problems, or other technical issues.
09Market risk
Financial markets are influenced by unpredictable factors, including economic releases, interest rate changes, liquidity conditions, and geopolitical events. Market volatility may lead to substantial or total losses. You are solely responsible for evaluating whether trading in such conditions is appropriate for your goals and risk tolerance.
10Cryptocurrency risk
Cryptocurrency markets are highly volatile and speculative. Values can fluctuate dramatically within short periods. Trading digital assets may result in total loss. Regulatory uncertainty, cybersecurity risks, and limited consumer protections may increase these risks.
11Third-party, broker, VPS & counterparty risk
Use of kazpa products may involve brokers, liquidity providers, VPS providers, data feeds, payment processors, or other independent third-party services. kazpa does not control and cannot guarantee the performance, reliability, pricing, execution, spreads, slippage, or practices of third parties.
You agree that kazpa is not liable for losses arising from third-party errors, failures, delays, outages, misconduct, or broker execution practices.
12Hypothetical results
HYPOTHETICAL PERFORMANCE RESULTS HAVE MANY INHERENT LIMITATIONS. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown in examples or simulations. Hypothetical trading does not involve financial risk and cannot account for the impact of liquidity, slippage, spreads, execution, or the emotional and real-world factors affecting live performance. One of the limitations of hypothetical performance results is that they are generally prepared with the benefit of hindsight.
